Article 1 — Definitions
In these terms and conditions the following definitions apply:

Business: Dutchrailworker B.V., trading as Dutchrailworker, established in Gorinchem, the Netherlands.

Consumer: the natural person not acting for purposes related to their trade, business, craft, or profession.

Distance contract: a contract concluded between the Business and the Consumer within the framework of an organized system for the distance sale of products, whereby, up to and including the conclusion of the contract, exclusive use is made of one or more means of distance communication.

Right of withdrawal: the Consumer's option to withdraw from the distance contract within the cooling-off period.

Cooling-off period: the period during which the Consumer can exercise their right of withdrawal.

Durable medium: any means — including email — that allows the Consumer or Business to store information addressed to them personally in a way that enables future reference and unchanged reproduction of the stored information.
Article 2 — Identity of the Business

Article 3 — Applicability
- These general terms and conditions apply to every offer made by the Business and to every distance contract concluded between the Business and the Consumer.
- Before the distance contract is concluded, the text of these terms and conditions is made available to the Consumer in such a way that it can be easily stored on a durable medium.
- If specific product terms apply, they take precedence over these general terms in the event of conflict, unless the Consumer cannot invoke them.
Article 4 — The Offer
- If an offer has a limited period of validity or is subject to conditions, this is explicitly stated in the offer.
- The offer contains a complete and accurate description of the products offered. The description is detailed enough for the Consumer to make an informed assessment of the offer. Minor variations in color, material, or finish compared to the images on the website are not grounds for cancellation, provided the delivered product reasonably matches the description.
- Obvious mistakes or errors in the offer do not bind the Business.
Article 5 — The Contract
- The contract is concluded at the moment the Consumer accepts the offer by placing an order and meets the associated conditions.
- The Business immediately confirms receipt of the order electronically. As long as receipt of this acceptance has not been confirmed, the Consumer may cancel the contract.
- The Business takes appropriate technical and organizational measures to secure the electronic transmission of data and provides a secure web environment. Payments are processed via Shopify's payment providers.
Article 6 — Right of Withdrawal
- The Consumer has the right to withdraw from the contract within a period of 100 days without giving any reason. This is significantly longer than the statutory 14-day cooling-off period.
- The withdrawal period expires 100 days after the day on which the Consumer or a third party designated by the Consumer (other than the carrier) physically takes possession of the product.
- To exercise the right of withdrawal, the Consumer sends an email to
returns@dutchrailworker.nl with the order number and the reason for return. For the full return procedure, please see the Refund Policy.
- During the cooling-off period, the Consumer will handle the product and its packaging with care. They will only unpack or use the product to the extent necessary to establish its nature, characteristics, and functioning.
- The product must be returned unworn, unwashed, and with all original labels intact.
Article 7 — Costs in Case of Withdrawal
- The return cost is €4.95 and is deducted from the amount to be refunded, unless the product was defective or incorrectly delivered — in that case the Business bears the return cost.
- The Business refunds the purchase amount including any shipping costs paid within 14 days of receiving the returned product, using the same payment method the Consumer used.
Article 8 — Exclusion of the Right of Withdrawal
The right of withdrawal is excluded for:
- Products that are clearly personal in nature.
- Products that by their nature cannot be returned.
- Products marked as clearance or sale, provided this was clearly stated in advance ("Final Sale").
Article 9 — Price
- During the period of validity stated in the offer, prices of the products offered will not be increased, except for price changes resulting from changes in VAT rates.
- All prices stated on the website are in Euros and include 21% VAT, excluding shipping costs, unless stated otherwise.
- Shipping costs within the Netherlands are €4.95 and are free for orders over €50. Shipping costs for Belgium follow the rates published on the website.
Article 10 — Conformity and Warranty
- The Business warrants that the products meet the contract, the specifications stated in the offer, reasonable standards of soundness and/or usability, and the statutory provisions and/or government regulations in force at the date the contract is concluded.
- The statutory warranty applies to the products. Statutory warranty means that a product must do what the consumer can reasonably expect from it.
Article 11 — Delivery and Performance
- The place of delivery is the address the Consumer has provided to the Business.
- The Business will fulfill accepted orders with due speed, no later than within 30 days, unless a different delivery period has been agreed. Orders placed before 4:00 PM on business days are usually shipped the same day and delivered the next business day in the Netherlands; Belgium takes 2-3 business days.
- The risk of damage and/or loss of products remains with the Business until delivery to the Consumer.
Article 12 — Payment
- Payment is made via the payment methods offered during the ordering process: iDEAL, credit card (Visa/Mastercard), PayPal, Apple Pay, Bancontact, and Klarna (pay later).
- The Consumer has the obligation to promptly report any inaccuracies in payment details provided or stated to the Business.
Article 13 — Complaints Procedure
- Complaints about the performance of the contract must be submitted to the Business fully and clearly described within a reasonable time after the Consumer has discovered the defects. Preferably by email to info@dutchrailworker.nl.
- Complaints submitted to the Business are answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the Business will respond within that period with an acknowledgment of receipt and an indication of when the Consumer can expect a more detailed reply.
- The Consumer must in any event give the Business 4 weeks to resolve the complaint by mutual agreement.
Article 14 — Disputes
- Contracts between the Business and the Consumer to which these general terms apply are governed exclusively by Dutch law.

Article 15 — Additional Provisions
Additional provisions or provisions deviating from these general terms and conditions may not be to the disadvantage of the Consumer and must be recorded in writing, or in such a way that they can be stored by the Consumer in an accessible manner on a durable medium.
